Welcome to Posely

Posely is provided as the Posely mobile application, including under the application identifier com.getposely.app.

These Terms of Use ("Terms") govern your use of the Posely mobile application ("the App"), website, and related services.

By downloading, accessing, or using Posely, you agree to these Terms.

If you do not agree with these Terms, please do not use Posely.

1. About Posely

Posely is a creative photography and photo-editing application designed to help users plan, capture, style, and edit photos.

Posely may provide features including:

Pose inspiration
Pose and framing guides
Camera overlays
User-uploaded pose references
Text and decorative elements
Outlines and cutouts
Text-behind-subject effects
Filters
Beauty adjustments
Sketch and drawing tools
Handwritten notes and annotations
Templates
Collages
Photo saving and sharing tools

Features may be added, modified, removed, or improved over time.

2. Pose and Camera Guidance

Pose overlays, framing guides, camera tips, and other guidance provided by Posely are creative assistance tools.

They are intended to help users recreate poses, framing, compositions, or visual ideas.

They do not guarantee:

Exact pose matching
Professional photography results
Any particular appearance
Any particular social-media performance or engagement
Any specific creative outcome

You remain responsible for how you position yourself, your device, and other people while taking photographs.

3. Photo Editing Features

Posely provides creative editing tools that may alter the visual appearance of photographs.

These may include:

Filters
Beauty effects
Outlines
Cutouts
Sketch and drawing
Handwritten notes
Templates
Collages
Text
Decorative elements

Results may vary depending on factors including:

Photo quality
Lighting
Device capability
Image orientation
Subject positioning
Selected effects and settings

Some effects use automated on-device image analysis and may not work perfectly on every image.

4. Beauty Tools

Beauty tools are provided for creative photo editing.

Depending on the feature selected, Posely may apply effects such as:

Smoothing
Glow
Dewy effects
Blush
Lip colour
Other appearance adjustments

Beauty tools are not intended to provide medical, dermatological, cosmetic, health, or professional advice.

You control whether and how these effects are used.

5. Sketch Tools

Sketch allows users to draw, annotate, and add handwritten-style content to images.

You are responsible for any text, drawings, symbols, notes, or other content you create using Sketch.

You must not use Posely to create, publish, or distribute content that violates applicable law or the rights of another person.

6. Your Photos and Content

You retain ownership of photographs, drawings, text, and other original content you create or import into Posely.

Using Posely does not transfer ownership of your content to us.

You are responsible for ensuring that you have any rights, permissions, or licences necessary to use photos, references, graphics, or other content you import, edit, save, or share.

7. Photos of Other People

When photographing, editing, or sharing images of other people, you are responsible for respecting their:

Privacy
Consent
Image rights
Intellectual-property rights
Other rights under applicable law

You should obtain permission where required before photographing, editing, publishing, or sharing images of another person.

8. Intellectual Property

Posely and its proprietary materials, including its:

Name
Branding
Logo
Interface
Original graphics
Pose collections
Software
Designs
Original templates
Original written content

are protected by applicable intellectual-property laws.

Except where expressly permitted by law or by us, you may not copy, reproduce, redistribute, reverse engineer, sell, license, or commercially exploit Posely or its proprietary content.

9. User-Provided Reference Images

Posely may allow you to upload your own photo or image as a pose reference.

You are responsible for ensuring that you have the right to use any reference image you provide.

Posely's ability to let you privately use or edit an image within the App does not grant you copyright, ownership, publicity rights, or any other rights in that image.

10. Acceptable Use

You agree not to use Posely to:

Violate applicable laws
Infringe intellectual-property rights
Violate another person's privacy or other rights
Harass, abuse, exploit, or harm others
Attempt to interfere with or compromise the security of Posely
Reverse engineer the App except where permitted by applicable law
Circumvent technical restrictions
Use Posely in a way that disrupts or damages the App or third-party services

11. Device Permissions

Some Posely features require access to your device camera or Photo Library/media storage.

If you deny a required permission, the relevant functionality may not work.

Permissions can be managed through your device settings.

12. Machine Learning

Some Posely features use on-device machine-learning technology, including Google ML Kit, to perform functions such as:

Subject segmentation
Face detection
Facial feature or contour detection used to position creative effects

Posely does not upload your photos to Posely-operated servers for machine-learning processing.

Machine-learning results are automated and may occasionally be incomplete, inaccurate, or unavailable depending on factors such as:

Image quality
Device
Lighting
Subject positioning
Visibility
Other technical conditions

Posely does not use these tools for:

Facial recognition
Identity verification
Authentication
Biometric identification

Google specifically states that its ML Kit face-detection API detects faces and facial features but does not recognise people.

You should not rely on Posely's automated image-processing results for safety-critical, medical, identification, authentication, or other high-risk purposes.

13. Availability and Changes

We may modify, improve, replace, suspend, or discontinue Posely features from time to time.

We do not guarantee that:

Every feature will always remain available
Posely will work on every device
Every editing effect will produce the same result
Every automated feature will be accurate
The App will always operate without interruptions or errors

We may make changes to improve functionality, performance, security, compatibility, or user experience.

14. Free Features and Future Paid Features

Posely may provide some or all functionality free of charge.

We may introduce optional paid functionality, subscriptions, in-app purchases, or other premium services in the future.

If we introduce paid functionality, applicable pricing and payment terms will be shown before you make a purchase.

Nothing in these Terms requires Posely to introduce paid functionality.

15. Third-Party Services

Posely may depend on third-party software, SDKs, libraries, operating-system services, or app-distribution platforms.

Your use of those services may also be subject to the relevant third party's terms, policies, and technical requirements.

16. Disclaimer

To the extent permitted by applicable law, Posely is provided on an "as is" and "as available" basis.

We do not guarantee that Posely will:

Always be uninterrupted
Be completely error-free
Produce perfect image-processing results
Meet every user's creative expectations
Be compatible with every device or operating-system version

Nothing in these Terms excludes, restricts, or modifies rights that cannot lawfully be excluded, restricted, or modified.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Posely and its operator will not be liable for indirect, incidental, special, consequential, or similar losses arising from your use of, or inability to use, Posely.

This includes loss arising from:

User-created content
Third-party services
Device or operating-system issues
Automated image-processing results
Creative decisions made using Posely

Nothing in these Terms limits or excludes liability where doing so would be unlawful.

18. Termination

You may stop using Posely at any time, including by uninstalling the App.

We may restrict or discontinue access where reasonably necessary to:

Protect Posely or its users
Protect our legal rights
Address misuse
Comply with applicable legal requirements

19. Changes to These Terms

We may update these Terms as Posely changes.

When we make material changes, we will update the effective date and, where appropriate, the version number shown at the top of these Terms.

Continued use of Posely after updated Terms become effective constitutes acceptance of the updated Terms where permitted by applicable law.

20. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without limiting any mandatory consumer protections or other rights that may apply to you under applicable law.

Nothing in these Terms is intended to exclude, restrict, or modify rights or remedies that cannot lawfully be excluded, restricted, or modified, including applicable rights under Australian consumer law.

21. Apple App Store

If you download Posely through Apple's App Store, you acknowledge that these Terms are between you and Posely and not Apple.

Apple is not responsible for Posely or its content, maintenance, support, or warranties except to the extent required by applicable law.

If these Terms operate as a custom end-user licence agreement for the iOS version of Posely, Apple and Apple's subsidiaries are intended third-party beneficiaries and may enforce applicable provisions against you as third-party beneficiaries.
